FCCPC Summons Air Peace Over Flight Cancellations and Unprocessed Refunds

Nigeria’s Federal Competition and Consumer Protection Commission (FCCPC) has summoned the management of Air Peace following a wave of passenger complaints regarding unprocessed ticket refunds, particularly in cases of flight cancellations.

In a statement issued by its Director of Corporate Affairs, the Commission stated that Air Peace may have breached Sections 130(1)(a), 130(1)(b), and 130(2)(b) of the Federal Competition and Consumer Protection Act (FCCPA) 2018. These provisions guarantee consumers the right to timely refunds for prepaid services that are not rendered due to the service provider’s fault and safeguard consumers from unfair treatment and practices.

Exercising its authority under Sections 32 and 33 of the Act, the FCCPC issued a formal summons dated June 13, 2025, requiring Air Peace to appear before the Commission in Abuja on June 23, 2025. The Commission emphasized that failure to comply with the summons is a violation of Section 33(3) and could attract sanctions, including fines or imprisonment.

Air Peace is also expected to provide key documents as part of the inquiry, including:

  • A comprehensive log of refund-related complaints from the past year,

  • Records of processed refunds,

  • A list of cancelled flights across all routes within the same period,

  • Details of steps taken to reduce the impact of cancellations on passengers.

This action is separate from an earlier investigation initiated in December 2024 concerning alleged exploitative pricing practices by the airline. That inquiry focused on abrupt hikes in ticket prices for future bookings, prompting Air Peace to file a legal suit challenging the Commission’s authority.

Despite ongoing litigation, the FCCPC has reaffirmed its dedication to enforcing consumer protection laws and ensuring Nigerian businesses, including airlines, are held accountable for practices deemed unfair or exploitative.
